persons, that is to say, to hold the same for the benefit use and advantage of the Carolina City Land Company, according to the tenor & effect of the aforementioned articles of agreement & upon trust to convey the same to the corporation when chartered and to such persons as the stock-holders may in general meeting determine & the said H.G. Cutler doth hereby covenant to and agree with the parties of the second part the survivors & survivors of them his hiers and assigns the title to the aforesaid tract of land & every part Thereof to warrant and forever defend against the claim of any person whatsoever & he doth further covenant to & with the said partners the survivors & survivors of them his heirs & assigns that he is lawfully seized of an indefinable [[?]] estate of inheritance in the said lands and every part Thereof and that he hath good right to convey the same & that the same is not incumbered by any Mortgage or trust thereon or lien of any kind whatsoever In witness whereof the said Cutler hath hereunto set his hand & seal the day and date above written — Witness — G W Taylor H.G.
