Bureau of Refugees, Freedmen &c Fayetteville, N. C. December 10^th 1866 Bvt. Brig. Genl. Allan Rutherford Sup. Southern District Wilmington, N. C. Sir I would Respectfully represent that at the December term of the County Court for this (Cumberland Co.) held at this place the last [[week ?]], in a case of the State against J. P. Barnes & Elizabeth Chance (whites) for larceny, Thomas McDaniel & Harrison Mayner, two respectable colored citizens, were denied the right to testify for the defendants, by the Court - it being against the laws of North Carolina for colored persons to testify in cases when whites are parties - Thus setting aside the provisions of civil rights Bill entirely. I had the Counsel for the defendants
