Feeling that their was no chance to gain it, we abandoned it. Judge Montgomery gave no opinion as to the title. The case was withdrawn from him by the pltff after & [[?dumped]]. I thought that Judge Montgomery throughout the trial acted with perfect fairness, & [[strikethrough]] wit h[[\strikethrough]] conducted himself with the interest properly, showing no leaning to one side, or the other, but evincing a strong desire to do justice to all the partiers. Had I have been dissatisfied with any of his [[?lings]] I should have excepted & taken the case to [[strikethrough]] the [[\strikethrough]] a higher [[strikethrough]] trial [[/strikethrough]] tribunal, but no exceptions were [[?plied]].
