Stanly Atty for Edward Stanly Makes application for restoration of property in New Berne. | Bureau Refugees, Freedmen &c Office S-in Agt New Berne NC Feb 7th 1866. Respectfully forwarded. Attention is called to any letter of this date. Seely. Fin Agent. L B page 745 749 950 | | The following abstract of title of Edward Stanly to escheatable lands in New Berne N.C. | Papers are forwarded with this application. Act of 1723 entitled "An Act for the better settling of the town of New Berne NC in the precinct of Craven" gives to Cullen Pollock his heirs and assigns "to take and succeed to the absolute fee of any lots in said town whereof any person or persons shall die possessed without leaving heirs or making a will of said lot or lots." This title in 1765 vested in Cullen and Thomas Pollock and was during this year confirmed by Act of Assembly which gives title in the fullest possible manner to all lands escheated or escheatable which has or may hereafter become vested in them. Cullen & Thomas Pollock sell to Wm Dry who conveys by will to Sarah Dry who marries Benjamin Smith. Benj Smith & Sarah his wife convey by deed to John Stanly, from whom the property has gone by descent to various heirs who by deeds of different dates have conveyed to Edward Stanly the present claimant |
