Transcription
United States vs. One Tract of land, seized as the property of D.H. Gallaher. 15th Dist Roane Co. Information No. 198. Be it remembered that this cause came on to be heard, on this 28h day of May, 1867, a trial by jury being carried, before the Hon. Conally F. Trigg, Judge &c, upon the information and other pleadings in the cause, and the proofs. From all which it appears to the court that David H. Gallaher, the refuted owner of the property seized in this cause, has taken the oath of amnesty prescribed in the Presidents proclamation of May 29th, 1865. But because it also appears there was probably cause for the seizure, the same will be so certified. Thereupon it is considered by the court that the information in this cause be dismissed, and that the property seized be restored to David H. Gallaher, upon judgment of the costs of the cause, for which let execution issue. And as part of said costs the court doth allows $20- to James P. Swann the former owner, $30.00 to C.W. Hall the present Dist. Att. $25- to the clk. $15- to the Marshall and a printers fee of $10- and a writ of possession is awarded, subject to any existing lease of the property, seized by the Freedmens Bureau.
