Original YOKOHAMA AGENCY, JOHN W. CAIN,- Agent HEAD OFFICE, SHANGHAI. No. 7/20038 PAYABLE IN Detroit Amount Insured Yen: 500.00 Ex. at 50 P Yen:= $250.00 Including risk of fire at Hatoha and Customs compound for seven days whilst awaiting shipment. Also including risk of fire for a period not exceeding seven days whilst awaiting final delivery to the consignees, provided that the interest is still at the risk of the assured: but free from all claims in respect of Fire on land if the interest is covered by insurances whether prior or subsequent hereto in date protecting it specially against Fire, or which would so protect it in the absence of a Marine Policy. This policy shall not inure to the benefit of any carrier or Fire Insurance Company. AVERAGE PAYABLE ON EACH PACKAGE AS IF SEPARATELY INSURED OR ON THE WHOLE. [[strikethrough]] Warranted free from Particular Average, unless the Vessel or Craft be stranded, sunk or burnt, or the damage or loss be caused by collision with another Vessel, but to pay and Special Charges for Warehousing, Re-shipping or Forwarding, for which this Association would otherwise be liable as well as the insured value of any Package or Packages, which may be totally lost in transhipment. [[/strikethrough]] Each Craft or Lighter to be deemed a separate Insurance. Grounding in the Suez Canal not to be deemed a Strand, unless the damage may be proved to have directly resulted therefrom. General Average and Salvage Charges payable as per Official Foreign Adjustment, if so made up, or per York-Antwerp Rules, if in accordance with the Contract of Affreightment. Held covered in event of deviation, or change of voyage, at a premium to be arranged, provided notice of such deviation. or change of voyage be given on receipt of advices. The Policy not to inure to the benefit of any Carrier or Fire Insurance Company and it is warranted and agreed that any insurance against Fire granted herein shall not cover where the Assured or any Carrier or other Bailee has fire insurance which would attach if this policy had not been issued. Freer Esq As well in his or their own Name, as for and in the Name and Names of all and every other Person or Persons, to whom the same doth, may or shall appertain in part or in all; do make INSURANCE, and hereby cause himself or themselves and them and every of them to be INSURED, lost or not lost, at and from the Port of Yokohama upon Goods and Merchandises, or Treasure, of and in the good Ship or Vessel called the S/S "Shinano Maru" whereof if Master, under GOD, for this present Voyage, or whosoever else shall go for Master in the said Vessel, or by whatsoever other Name or Names the said vessel or the Master thereof is or shall be named or called; BEGINNING the Adventure upon the said Goods and Merchandises from the loading thereof on board the said Ship, and so to continue and endure until the said Goods and Merchandises shall have arrived at Detroit, Mich. And until the same be there discharged and safely landed, Including risk of Craft to and from the Ship And it shall be lawful for the said Vessel, in this Voyage, to proceed and sail to, and touch and stay at any Ports or Places whatsoever, (within the limits of the above Voyage), for necessary Provisions, Assistance or Repairs, without prejudice to this INSURANCE; the said Goods and Merchandises laden thereon for so much as concerns the ASSURED, are and shall be Yen Five hundred Only Declared to be on Afd Charles L. Freer X & XX 2 cases Chinese Pottery Touching the Adventures and Perils which the said YANG-TSZE INSURANCE ASSOCIATION, LIMITED, themselves are content to bear, and to take upon them in this Voyage: they are of the Seas, Men of War, Fire, Enemies, Pirates, Rovers, Thieves, Jettisons, Letters of Mart and Counter Mart, Surprisals, Takings at Sea, Arrests, Restraints and Detainments of all Kings, Princes and People, of what Nation, Condition, or Quality soever; Barratry of the Master and Mariners, and of all other Perils, Losses, and Misfortunes, that or shall come to the Hurt, Detriment, or Damage of the said Goods and Merchandises, or any part thereof; and in case of any Loss or Misfortune, it shall be lawful for the ASSURED, his or their Factors, Servants, or Assigns, to sue, labor and travel for, in and about the Defence, Safeguard and Recovery of the said Goods and Merchandises, or any part thereof, without Prejudice to this INSURANCE; to the Charges whereof, the said ASSOCIATION will contribute. It is expressly declared and agreed, that no acts of the INSURER or INSURED in recovering, saving or preserving the property insured shall be considered as a waiver or acceptance of abandonment. AND it is agreed that this Writing or Policy of INSURANCE shall be of as much Force and Virtue as the surest Writing or Policy of INSURANCE mad in LONDON And so the said ASSOCIATION are contented, and do hereby promise and bind themselves, their Heirs, Executors, Goods and Chattels, to the ASSURED, his or their Executors, Administrators, or Assigns, for the true Performance of the Premises; confessing themselves paid the Consideration due unto them for this INSURANCE, at and after the rate of per cent. The said YANG-TSZE INSURANCE ASSOCIATION, LIMITED, covenant, promise, and agree, and oblige themselves their Heirs, Executors, Goods, and Chattels, in the case of Loss happening (which God forbid) to satisfy and pay in Detroit the sum of Money, by them so ASSURED, at expiration of thirty days after the first proper Notice and Proof of the Loss has been given to [[stamp]] Messrs. Willcox, Peck & Hughes, [[/stamp]] &/or their agents of New York Agent for the Office in Detroit and at the Exchange of 50 [[stamp]] CENTS U.S. GOLD FOR ONE YEN. [[/stamp]] and no abatement whatever shall be made, but the full sum shall be paid, any use or custom to the contrary notwithstanding. The adjustment of all average Losses, and other Matters, relating to this INSURANCE shall in like manner, be made by the said Agent agreeably to the tenor of this Policy, and according to the established practice there in such cases. ***Salt, Salpetre, Sugar, Jaggery, Rice, Corn, Flour, Seeds, Grain, Tobacco, Hides, Skins, Alum, and Spirits, and other Liquors, are warranted free from particular average under Ten per Cent, Tea and Silk under Three per Cent, and all other Goods, free from particular average under Five per Cent, also Vessel and Freight free of average, under Five per Cent, unless general or the Ship be stranded. All Liquid are warranted free from claims arising from leakage, or breakage of the packages. It is agreed that the practice of Lloyds shall be recognised as the standard for adjusting claims for particular average or partial loss. Warranted free of Capture, Seizure, and Detention, and the consequences thereof, or of any attempt thereat, piracy excepted, and also from all consequences of Hostilities, or Warlike Operations, whether before or after Declaration of War. IN WITNESS whereof, I, the Agent for THE YANG-TSZE INSURANCE ASSOCIATION, LIMITED, on behalf of the said ASSOCIATION, have subscribed my name in YOKOHAMA to two Policies of the same tenor and date, on of which being accomplished, the others to be void, this Eleventh Day of June in the Year One Thousand Nine Hundred and Seven.
