Dist. Va. Lynchburg, Aug 15th 67 H.54.2.V.67 Va. First Mil. Dist. Respectfully returned to Capt. R.S. Lacey, The horse in question was given Claiborne, at the time of the surrender by a union officer. Claiborne took him to Mr. Glover Harvey & he consented to the horse remaining providing he would be of any account Glover Harvey then got an order from Hix for a horse. - Hix's action was sustained by Capt. Philip Giser, P. Marshall. Claborne Harvey testifies he was offered $25. for the horse the spring of the surrender - Harvey has sold the horse for $100 - subject to call of the Gov't I would recommend that the horse be returned o Clayborne Harvey for the reason that I have no evidence to show that Mr. Hix was authorized to take horses from those to whom they had been given.
