2. That the boy Thomas was, so far as the rights of a parent was concerned, the lawful child of the said Washington,

3. That the county court of Warren had no authority to bind this boy without the consent of parent & child, unless by virtue of some act of assembly

4. That the Revised Code Chap 5. Section 1 enumerates the  classes of persons over whom the court has this jurisdiction by act of assembly and that this case does not come within either of the enumerated classes. [[cross symbol]]

5. That the binding in this case was void, because it was  contrary to law, done without notice to the parent and without the presence of the child, and done in violation of the Rules established by the Public authorities for the government of this Court of the State.

After argument the Court gave judgement to the following effect the court announcing that it stood   3 for denial & one for granting to end it.

 That the motion is denied; and that the boy Thomas and the reputed  father  being now present in court, that the court now ratifies & confirms the  former binding of said Thomas to said Nath Nicholson.

Your petitioner sought the protection  of the court and for that purpose brought his boy and delivered him to the court, and not in pursuance or by virtue of a notice  from Mr. Nicholson that a new binding would be attempted; and he considers it a though it was unfairly taking advantage of the opportunity afforded by his voluntarily  seeking the aid of the court with his son to seize and bind him anew, or in other words taking an unfair advantage to amend & defective proceeding.

Your petitioner was advised by his counsel that he could take an appeal to the Supreme Court by giving security for costs, and that the case might be determined at the spring term of that court - April; yet that it might be continued over several terms.  That a  more speedy but more expensive mode of redress was by writ of Hubris Corpus.
