   According to Art. 4 of the treaty of 1866, these people have no rights to allotments of land and their improvements made in good faith during the past 6 years do not belong to them.  Although this be true, justice seems to demand a recognition of their work.
   Therefore, I would decide that in view of a residence of over 6 years taken up in good faith, spent in industry, resulting in permanent improvements which enhance the value of the land to the Omahas, that John Prouost, and his family be allowed allotments of land under the act of August 7, 1882.
