unincumbered.  Upon th^[[is]] 20 acres held by the R. R. a section house and some other buildings and improvements have been made by the R. R. Co., and a flag station established under the name of Flournoy, since the agitation and final establishment of the new county of Thurston, which embraces the Winnabago lands, Flournoy is sought as the site of a town and as the unallotted lands available for settlement after due negotiation with the tribe, are contiguous to this tract, the place becomes one of special importance.

Although Mrs. Lemmon has accepted certain lots on the Southern boundary of the Reservation as a complement for the 20 acres held by the R. R., within her 80 acres patented to her in 1887, still she is a loser on account of her permanent improvements made upon the R. R. tract. In view of this fact, she stipulates that should negotiations be made for the opening of the unallotted lands to settlement and forming of a town at Flournoy, she may have the opportunity under certain conditions to assign her present allottment and take  other adjacent land, in order that there be no impediment in the way of the future development and prosperity of that locality.
