HEADQUARTERS DEPARTMENT OF NORHT CAROLINA, Raleigh, North Carolina, November 14th, 1865. GENERAL ORDERS.} No. 158. } Before a General Court Martial which convened at Headquarters Tenth Army Corps, Raleigh, North Carolina, on the 12th day of July, 1865, pursuant to Special Orders, No. 91, dated Headquarters Tenth Army Corps, District of Raleigh, North Caroline, July 11, 1865, and of which COL. C. R. McDONALD, 47th Regiment, New York Volunteer Invantry was President, was arraigned and tried--Private John Thomas, Co. E, Third Regiment U, S. Artillery. CHARGE. Burglary. FINDING: "Guilty." SENTENCE. To forfeit to the United States all pay and allowances that may be due him; to be dishonorably discharged the service of the United States, and be confined for the term of three (3) years in such Penitentiary as the proper authority shall direct. II. The sentence in the foregoing case, by act of Congress approved March 3, 1863, published in General Orders, No. 73, War Department, A G. O., 1863, should have ordered a punishment not less than that prescribed for burglary, by the laws of North Carolina. The aforesaid act of Congress having not been complied with, and it not being practicable to reconvene the Court, owing to the muster out of service of its members, the sentence is disapproved, and the prisoner will be released from arrest, and returned to duty.
