GENERAL ORDERS. } NO. 161. } I. * * Before a General Court-Martial convened at Wilmington, North Carolina, September 1st, 1865, pursuant to Special Orders No. 164, dated Headquarters Department of North Carolina, Raleigh, North Carolina, August 26th, 1865, and of which Captain C. H. WHITNEY, 37th U. S. C. T., is President, was arraigned and tried: Captain John F. Deveraux, 6th United States Colored Troops. CHARGE I. Drunkenness on Duty, in Violation of the 45th Article of War. Specification 1st. In this, that the said Captain John F. Deveraux, 6th U. S. C. T., while on duty as regimental officer of the day, did become drunk, so as to wholly disqualify him from performing his duty as officer of the day. This at Camp of 6th U. S. C. Troops, near Raleigh, N. C., on or about the 24th day of April, 1865. Specification 2d. In this that the said Captain John F. Deveraux, 6th U. S. C. T., while on duty as regimental officer of the day, did become drunk, so as to wholly disqualify him from performing his duty as officer of the day. This at Camp 6th U. S. C. T., near Wilmington, N. C., on or about the 19th day of June, 1865. CHARGE II. Violation of the 39th Article of War. Specification. In this, that the said Captain John F. Deveraux, 6th U. S. C. Troops, did receive from Major Stuart, Paymaster, U. S. Army, the pay of Sergeant William Moxfield, Co. I, 6th U. S. C. Troops, amounting to ($272.25) two hundred and seventy-two dollars and twenty-five cents, or thereabouts in United States currency, on the muster and pay rolls of Company I, 6th U. S. C.
