To which charges and specifications the prisoner, Private Thomas C. Duggit, Co. D, 6th U. S. C. T., pleaded, "Not Guilty." FINDING. The Court having maturely considered the evidence adduced, does find the accused, Private Thomas C. Duggitt, Co. D, 6th U. S. C. T., as follows: CHARGE I. Of the specification to the charge, "Guilty." Of the charge, "Guilty." CHARGE II. Of the specification to the charge, "Guilty." Of the charge, "Guilty." CHARGE III. Of the specification to the charge, "Guilty," substituting the words "did incite other," for the world "did;" also, the words "incite others to rob," for the words "personally steal from said tent or building." Of the charge, "Guilty." SENTENCE. And the Court does therefor sentence him, Private Thomas C. Duggitt, Co. D, 6th U. S. C. T, "To be shot to death with musketry at such time and place as the Commanding General shall direct, two-thirds of the Court concurring." II. The proceedings, findings and sentence in the foregoing case are disapproved. The record does not show that the prisoner was present during the proceedings of the evening session of the first day.
