CHARGE III. Receiving and secreting Public Property knowing the same to have been stolen. Specification--"In this, that he, Jacob Stout, Citizen, did, on or about the 5th day of October, 1865, receive from some person or persons unknown, two single setts Wheel Harness, three Mule Collars, one Bridle and one Lead Line, the property of the United States, of great value, to-wit: Of the value of Forty Dollars, which had been previously stolen from the Park of Captain C. W. Leffingwell, A. Q. M., he, the said Jacob Stout, did then and there well know that said property had been stolen, and did then and there secrete the same in an out house near his dwelling . All this in Charlotte, North Carolina, as aforesaid." To which Charges and Specifications the prisoner pleaded, "Not Guilty." FINDING. The Commission having maturely considered the evidence adduced, does find that the prisoner, Jacob Stout, Citizen, of Charlotte Mecklenberg County, North Carolina, as follows: CHARGE I. Of the Specification to the Charge, "Not Guilty." Of the Charge, "Not Guilty." CHARGE II. Of the Specification to the Charge, "Not Guilty." Of the Charge, "Not Guilty." CHARGE III. Of the Specification to the Charge, "Not Guilty." Of the Charge, "Not Guilty." And the Commission does therefore fully acquit the said Jacob Stout, Citizen, of every part of the aforesaid charges. II The proceedings, findings and acquittal in the foregoing case are disapproved. The finding is not in accordance with the evidence. The prisoner will be released from confinement.
