GENERAL ORDERS,}
NO. 58.}

I.  Before a General Court Martial which convened at the Citadel, Charleston S. C., pursuant to Special Orders No. 70, (current series,) from these Headquarters, and of which Major LYMAN BISSELL, 29th U. S. Infantry, is President, were arraigned and tried:

1.  Private John Schoulmeyer, Company D, 8th U. S. Infantry.

CHARGE – "Conduct to the prejudice of good order and military discipline."

Specification 1st – "In this, that Private John Schoulmeyer, of Company D, 8th U. S. Infantry, did resist the police of the city of Wilmington, N. C., in the discharge of their duty, and did thereby assist or cause the escape from the custody of the police, of Private Henry Herbert, Company D, 8th U. S. Infantry, arrested for larceny.  This at Wilmington, N. C., on or about the 31st day of May, 1867."

Specification 2d – "In this, that Private John Schoulmeyer, of Company D, 8th U. S. Infantry, did resist the police while they were in the act of arresting him, and did, while in their custody, assault and otherwise abuse the police.  This at Wilmington, N. C., on or about the 31st day of May, 1867."

Specification 3d – "In this, that he, Private John Schoulmeyer, of Company D, 8th U. S. Infantry, did appear on the streets of Wilmington, N. C., in a state of intoxication, and did, by assaulting the police and by other violent and boisterous conduct, greatly disturb the peace and quiet of the city of Wilmington.  This at Wilmington, N. C., on or about the 31st day of May, 1867."

PLEA.  "Not Guilty."

FINDING.  "Guilty."

SENTENCE.

"To forfeit ten ($10) dollars per month of his pay for two (2) months, and to be confined at hard labor, in charge of the guard for the same period."

1.  Private Bernard Brennan, Company D, 8th U. S. Infantry.
