the police, of Private Henry Herbert, Company D, 8th U. S. Infantry, arrested for larceny.  This at Wilmington, N. C., on or about the 31st day of May, 1867."

Specification 2d – "In this, that Private Bernard Brennan, of Company D, 8th U. S. Infantry, did resist the police while they were in the act of arresting him, and did, while in their custody, assault and otherwise abuse the said police.  This at Wilmington, N. C., on or about the 31st day of May, 1867."

Specification 3d – "In this, that he, Private Bernard Brennan, of Company D, 8th U. S. Infantry, did appear on the streets of Wilmington, N. C., in a state of intoxication, and did, by assaulting the police and by other violent and boisterous conduct, greatly disturb the peace and quiet of the city of Wilmington.  This at Wilmington, N. C., on or about the 31st day of May, 1867."

PLEA.  "Not Guilty."

FINDING.  "Guilty."

SENTENCE.

"To forfeit ten ($10) dollars per month of his pay for two (2) months, and to be confined at hard labor, in charge of the guard, for the same period."

3.  Private Barney Ennits, Company H, 40th U. S. Infantry.

CHARGE – "Conduct prejudicial to good order and military discipline."

Specification 1st – "In this, that he, Private Barney Ennits, Company H, 40th U. S. Infantry, did strike with his fist James F. Kornegay, citizen, and did demand the watch and chain of the said Kornegay.  This on the street in Goldsboro', N. C., on or about the afternoon of April 29th, 1867."

Specification 2d – "In this, that Private Barney Ennits, Company H, 40th U. S. Infantry, did, on or about the afternoon of the 29th day of April, 1867, stop Dr. George L. Kirby, citizen, on a street in Goldsboro', N. C., and demand of him his watch, thereby disturbing the peace and quiet of the community.  This at Goldsoro', N. C."

Specification 3d – "In this, that Private Barney Ennits, Company H, 4th U. S. Infantry, did on or about the afternoon of the 29th day of April, 1867, without cause or provocation, offer violence to W. H. Holt, citizen, by striking him with his fist, thereby disturbing the peace and quiet of the community.  This at Goldsboro', N. C."

PLEA. 
 
To the first specification, "Guilty," except the words "and did demand the watch and chain of said Kornegay."
