Respectfully returned to [[underlined]] Genl. E. Whittlesey, A.A.A.Genl. [[/underlined]] with report as follows:  The lumber herein referred to was sent to Chaptico in 1868 by [[underlined]] Rev. J Kimball [[/underlined]] then Supt. of Education to

to build a school house at that point, it being agreed that the colored people of that neighborhood would erect the building.  The lumber has lain there since that time, some of it having been stolen, the balance slowly decaying, and nothing done by the people.  On Feb. 24th 1870 the school building at Oakville was destroyed by fire, and the colored people having applied for help to rebuild their school, A request was made for me to allow this lumber to be turned over to the Trustees of the school at Oakville.  On the 7th of April 1870 an order was issued by the Commissioner authorizing said transfer.

The enclosed deed has been examined as directed.  It does not appear that the land described was deeded with reference to the education of Freedmen, or children irrespective of race or color, forever.
It seems to have been conveyed for religious purposes, and for a free school forever.  It seems, however, from the statement of the grantor in his communication, enclosed, that the land was purchased by colored citizens, and in view of this fact it is considered by the Chief Quartermaster, that the deed complies, substantially with the requirements of Bureau regulations.
