11. [[underlined]]Larsen and State of Wisconsin v. United States[[/underlined]]

This was a personal injury case brought under the Federal Tort Claims Act. The case was filed in the U. S. District Court for the Western District of Wisconsin in the amounts of $750,000 and $12,760.14 respectively. Co-plaintiff Larsen is a museum registrar for the Wisconsin Historical Society. She was allegedly injured while visiting the Institution's Silver Hill facility when she fell from a platform, fracturing her skull. The State of Wisconsin claimed $12,760.14 over and above the amount claimed by Co-plaintiff Larsen for reimbursement of the amounts it had paid in total disability benefits. Following lengthy pretrial negotiations and discovery proceedings, a settlement agreement in the amount of $40,000 was executed on November 21, 1984. The amount reflects reimbursement to the State of Wisconsin for the $12,760.14 paid Co-plaintiff Larsen under Workmen's Compensation.

MAJOR ADMINISTRATIVE CASES

1. [[underlined]]Appeal of Bromley Construction Co., Inc.[[/underlined]]

Bromley Construction Co., Inc., contracted to install a new roof at the American Art and Portrait Gallery building. Bromley submitted an administrative appeal from the Smithsonian Contracting Officer's decision denying a claim for an additional $172,000 as a result of a defective specification and a suspension of work ordered by the Smithsonian. The claim included a large amount for the Contractor's overhead. After a thorough review by the Smithsonian Contracting Officer, the Office of Audits, and the Office of the General Counsel, a settlement agreement was signed on November 2, 1984, granting the Contractor $75,000 of the claimed amount.
