I tracked where the cotton was carried by signes of straw and cotton lint on bushes about 1 1/4 Miles these signes appeard that the cotton was laid by the side of the road on some bushes there was the track of a Horse and waggon that from apperance come and got the cotton Mr B F Stainback and James Stainback wer with me at the road where the cotton was last laid down. Witness exibited [[underlined]] the Spike bar that was found by his barn door [[/underlined]] J W Duke duly sworn upon his oath sayes that he resides in Warren County NC that he is acquainted with Stephen Sutherland "The Sherrif Exibited the bar that was discribed by John F Stainbach and asked him if he ever saw the spike bar if so whare he saw it"

Witness said he new the bar, that he saw it at the house of Stephen Sutherland, on the plantation of Samuel Duke

James Stanback duly sworn upon his oath sayes that he resides in Franklin Co NC. that he had seen the defendant a few times says he helped John F Stanback trace some cotton from the barn of Mr Stanbeck that had been stolen the night before.
