AGREEMENT BETWEEN THE U.S. DEPARTMENT OF TRANSPORTATION 
FEDERAL AVIATION ADMINISTRATION, METROPOLITAN WASHINGTON AIRPORTS AND THE SMITHSONIAN INSTITUTION, WASHINGTON, D. C.
REGARDING THE LEASE OF CERTAIN PROPERTY AT WASHINGTON DULLES INTERNATIONAL AIRPORT FOR MUSEUM PURPOSES

AGREEMENT, entered into by and between the United States Department of Transportation represented by the Director, Metropolitan Washington Airports, Federal Aviation Administration (FAA), and the Smithsonian Institution ("Smithsonian"), a public trust instrumentality of the United States created by act of Congress;

WITNESS:

WHEREAS, the FAA owns and has developed certain real property known as the Washington Dulles International Airport (IAD); and 

WHEREAS, the Smithsonian's mission includes the storage, research, restoration, preservation and display of aviation and space artifacts (aerospace artifacts), including craft of historical significance, for the benefit of present and future generations and includes also aerospace-related research and educational activities; and

WHEREAS, the Smithsonian is considering leasing land at IAD from the FAA for the purpose of erecting facilities for storage, research, restoration, preservation and display of aerospace artifacts, and for the purpose of conducting aerospace-related research and educational activities; and

WHEREAS, the Smithsonian has determined that conditions at this time do not warrant the execution of a long-term lease which entails a present commitment to make improvements to the IAD land, but that conditions in the future may warrant a long-term lease for the accomplishment of museum objectives, including those referred to above; and
