Smithsonian Institution [[/underlined]] ([[underlined]] pro se, [[/underlined]] race discrimination) - Filed September 15, 1986, in the U.S District Court for the District of Columbia by a former guard who was temporarily employed in the Office of Protection Services, alleging discrimination on the basis of his race (white) under "Title VII of the Civil Rights Act of 1964, as amended, the Title 212 [sic] U.S.C. §§ 1981, 1983, and 1985(3)," and seeking reinstatement with full back pay and benefits and attorneys' fees. An administrative hearing before the EEOC found no discrimination. An answer was filed on or about November 18, 1986. A motion to dismiss or for summary judgment for failure to timely exhaust his administrative remedies was filed December 2, 1986.

9. [[underlined]] Dupree v. United States [[/underlined]] (tort claim for injuries allegedly sustained by plaintiff from a fall on January 13, 1984, in the National Museum of American Art) - Filed January 23, 1987, in the U.S. District Court for the District of Columbia. Plaintiff seeks $500,000 in damages. An answer to the complaint was filed April 22,1987. A pretrial conference is scheduled for November 5, 1987; trial is scheduled for November 16, 1987.

10. [[underlined]] Faust v. Adams [[/underlined]] (appeal of removal of  unsatisfactory performance by former microbiologist of the Smithsonian Environmental Research Center (Edgewater)) - Filed May 15, 1986, in the U.S. District Court for the District of Columbia, alleging removal was not meritorious, was procedurally defective, and was discriminatorily based on her age, sex, and national origin (Hungarian). Retroactive reinstatement to a suitable GS-13 position, a granting of a fully satisfactory performance evaluation for 1984 and of a retroactive within-grade increase, back pay and benefits, and attorneys' fees and costs are sought. Pretrial statements were filed March 30, 1987. A pretrial conference was held April 13, 1987, and trial was set for May 5-8, 1987. Trial was indefinitely continued, and settlement discussions are ongoing.

11. [[underlined]] Howse v. Adams (pro se [[/underlined]], race discrimination) - Filed November 3, 1986, in the U.S. District Court for the District of Columbia by a Smithsonian sheetmetal mechanic, alleging discrimination on the basis of race in failure to be promoted to the position of foreman in 1982. Promotion to the position of foreman, back pay, and punitive damages are sought. An answer was filed February 17, 1987. A status hearing was held April 15, 1987. Pretrial discovery is ongoing. A pretrial conference is scheduled for October 15, 1987. Trial is scheduled for November 2, 1987.

12. [[underlined]] Smith v. McKinnon, Smithsonian Institution, et al. [[/underlined]] (contest of the Last Will and Testament of Laura Isabelle O'Dea, under which the Smithsonian is the principal beneficiary of the estate, worth approximately $200,000) - Filed on July 25, 1986, in the Superior Court, San Diego, California, alleging that Ms. O'Dea made an oral promise to leave her entire estate to plaintiff in exchange for his caring for her during the last years of her life and seeking to have the alleged promise enforced by the imposition of a constructive trust for plaintiff's benefit on all the estate property. Pretrial proceedings are in progress.
