determine the appropriate uses of the building for exhibition, research, curation, and storage of the Heye collection and other collections to which the Nuseum has access consistent with the plan developed pursuant to the authority established in section 103(c)(8), and to prepare a report on the number of square feet (excluding the subbasement of the Custom House) that would be required to maintain the National Museum of the American Indian, George Gustav Heye Collection, New York; [[underline]]provided that[[/underline]]the amount of square feet proposed for exhibition purposes shall be no less than 90,000 square feet; and

(10) to exercise all other powers incident to the administration, maintenance, operation, and preservation of the Museum.

SEC. 104. (a) The identity of the collection of the Museum of the American Indian, Heye Foundation, shall at all times be retained and preserved, and the purposes of the trust established under the foundation deed executed and delivered by George Gustav Heye on May 10, 1916 in the City of New York as set forth in section 109 (a)(1) shall be preserved in perpetuity.

(b) Subject to limitations expressly provided by law, and in the case of a gift, subject to applicable restrictions under the terms of such gift and provided that such gift is made upon terms and conditions that are in harmony with the purposes of the Heye Foundation deed, the proceeds from the sale of any property acquired pursuant to section 103(c) (1) shall be maintained for the exclusive benefit of the Museum and accounted for separately from other funds of the Smithsonian Institution.

(c) All endownments for the benefit of the Museum of the American Indian, Heye Foundation in existence at the time of the transfer authorized pursuant to section 103(c)(1) shall be maintained for the exclusive benefit for the Museum and accounted for separately from other funds of the Smithsonian Institution.

SEC. 105. The Secretary of the United States Department of the Interior is authorized to --

(a) prepare an inventory of all items in the Native American collection of the Department;

(b) transmit a report on the inventory conducted pursuant to subsection (a) of this section to the Secretary of the Smithsonian Institution;

(c) enter into an agreement with the Secretary of the Smithsonian Institution for the access by the Museum to the Department's Native American collection and
