returned to the A.A.A. Gen'l 2d Mil District with recommendation that this case may be referred to Oscar Eastmond Esq. Bureau Agent at Asheville for investigation and report.
Endst. Louis V. Caziarc A.A.A. Gen'l Mch. 19" 1868. Respectfully referred to Bvt Col. Wm B Royall Commanding Post of Morganton.
Endst Bvt Col. Wm B. Royall. Mch. 19th 1868
Respectfully referred to Oscar Eastmond Agent Bureau, for compliance with Endst from H'd Qrs. 2d Mil Dist.

Respectfully returned to Bvt. Col. Wm B. Royall Comd'g Post of Morganton. I was present in Court when this case was tried and from the evidence adduced, I believed Mr Sumner to be not Guilty, notwithstanding the circumstantial evidence was strong against him. The actual guilt was certainly not proven. Taking into consideration the disparity of the case of Harvey Roberts (mentioned within) compared with this, I would recommend that Mr Sumner be relieved of the fine on his paying the Costs of Court.
