[[underlined]] James Parker[[underlined Col'd being duly Sworn state that his hog valued at $20 has been unlawfully taken from him by [[underlined]] Just Dennis[[underlilned]] Constable of Newport Carteret County N.C.  He further states that [[underlined]] William Small [[underlined]] of Newport hired his wife [[underlined]] Caroline Parker[[underlined]] to work for him agreeing for her services to ration him and Caroline his wife and give them [[homeroom?]]  In going to Small's he took a hog with him and purchased corn from [[underlined]] JL Bell [[underlined]] for whom he [[underlined]](James Parker) [[underlined was working.  Said Small wanted to purchase the Hog but he Parker refused to [[underlined]] sell[[underlined]]. Small then
fed the Hog against his (Parker's) Consent.  On or about the 18th day of January 1867 his (Parker's) wife was sick and unable to prepare breakfast.  Parker notified Small of that fact.  (Parker) then went to his work at J.L. Bell's. When he came to Small's in the evening he found that Small had driven his Parker's wife away he (Parker) then went and procured a ham for home for his wife and when he went to Smalls to get his property Small refused to let him take the hog his (Parker's) wife afterwards went and took the Hog.  Small then sued Parker for $4 50/100 Four dollars and fifty cents for feeding the Hog Said [[underlined]] Just Dennis [[underlined]] Constable came to where he (Parker) was working and took him before Mr. Bell Mayor of Newport this 24th day of January 1867  Small not present on the evening of the 25th of Jan'y 1867 he (Parker) and Small was before the Mayor who gave the judgement against (Parker) for the amount of Small's Claim at the same time the Mayor refused to allow the enclosed Claim "marked" "A" of Parker against Small.  he would not even allow Parker

to prove it a just account.  At the same time he the Mayor cut off a piece of the bill.  what it was the deponent does not know as he cannot read.  He further States that said Just Dennis Constable took away forcebly his hog on the 24th of January 1867 the day before Judgement or execution was given this he believes from the fact that he and Small was before the Mayor on the 25th of January 1867 to adjust the Case he further states that he has not got Justice nor will not before such tribunals as tried this case

Respectfully forwarded to [[underlined]] Lt Col S. Moore[[underlined]] VRC Supt for instructions in this matter.  The great misfortune in these Cases is that [[underlined]] Magistrates [[underlined]] do not consider that they are adjudicating between men equal before the law.  Their idea is that it is a controversy between a [[underlined]] White man[[underlined]] and a [[underlined]] Negro[[underlined]].  Hence the complaints of the propriety of their decision.  The distance from Here to Newport is 15 miles by land and 11 miles by water
