To All Non-Scheduled Aircraft Operators:

By the provisions of Section 2 of the Civil Aeronautics Act of 1938, Congress outlined a declaration of policy for the guidance of the Board in the exercise and performance of its powers and duties under the Act. Among other things prescribed for the Board's consideration, as being in the public interest, and in accordance with the public convenience and necessity the following are set forth therein:

"The encouragement and development of an air-transportation system properly adapted to the present and future needs of the foreign and domestic commerce of the United States, of the Postal Service, and of the national defense;

"The regulation of air transportation in such manner as to recognize and preserve the inherent advantages of, assure the highest degree of safety in, and foster sound economic conditions in, such transportation, and to improve the relations between, and coordinate transportation by, air carriers;

"The regulation of air commerce in such manner as to best promote its development and safety; and

"The encouragement and development of civil aeronautics."

The Board, as you know, by its Regulation issued October 18, 1938, as amended December 7, 1938, Section 292.1 of the Economic Regulations temporarily exempted non-scheduled operations from practically all of the economic provisions of Title IV of the Civil Aeronautics Act. 

This action was taken as a temporary expedient because the Board lacked adequate information concerning the scope and character of nonscheduled commercial air services conducted throughout the nation to intelligently determine upon a course of action consistent with the declaration of policy as set forth in the Act and which in the interest of the public and operators of such service would best meet the conditions and requirements of such air transportation.
