PART VIII. EXPOSURE and DISAPPEARANCE. When by reason of an accident covered by this policy the Insured is exposed to the elements and as the result of such exposure suffers a loss for which indemnity is otherwise payable hereunder, such loss will be covered under the terms of this policy.
If the body of the Insured has not been found within one year after the date of the disappearance, sinking or wrecking of the aircraft in which the Insured was riding at the time of the accident and under such circumstances as would otherwise be covered hereunder, it will be presumed that the insured suffered loss of life resulting from bodily injury caused by an accident at the time of such disappearance, sinking or wrecking.
PART IX. EXCLUSIONS. This policy does not cover loss, fatal, or non-fatal, caused by or resulting from (1) declared or undeclared war or any act thereof; or (2) suicide or self-destruction or any attempt thereat, while sane or insane (in Missouri while sane).
PART X. PRIVILEGE TO CONVERT. If there has been no covered loss under this policy, it may be converted without evidence of insurability to Beneficial Airsurance Policy, Form 846-666 for the amount of Principal Sum and Physician, Surgeon, Hospital and Nurse Expense Indemnity of this policy at the premium rate in effect at time of conversion. The new policy shall be effective on the effective date of this policy and the entire premium paid for this policy shall be credited toward the first annual premium on the new policy. Written request by the Insured for such conversion, payment of the balance of the annual premium for the new policy and surrender of this policy for conversion must be received by the Company on or prior to 30 days after the effective date of this policy.
PART XI. POLICY PROVISIONS. ENTIRE CONTRACT; CHANGES: This policy, including the endorsements and the attached papers, if any, constitutes the entire contract of insurance. No change in this policy shall be valid until approved by an executive officer of the Company and unless such approval be endorsed hereon or attached hereto. No agent has authority to change this policy or to waive any of its provisions.
NOTICE OF CLAIM: Written notice of claim must be given to the Company within thirty days after the occurrence or commencement of any loss covered by the policy, or as soon thereafter as is reasonably possible. Notice given by or on behalf of the Insured or the beneficiary to the Company at its Home Office in Los Angeles, California, or to any authorized agent of the Company, with information sufficient to identify the Insured, shall be deemed notice to the Company.
