GENERAL CONDITIONS OF INSURANCE

CONDITION A. On goods, and/or merchandise consisting principally of household furniture, clothing, wearing apparel and/or personal effects, but excluding accounts, bills, currency, deeds, evidences of debt, money, notes or securities, jewelry, pearls or precious stones. The limit of liability of this Insurance Company for each picture, drawing, sculpture, piece of statuary, work of art, musical instrument (excluding pianos), curiosity, rug, fur, piece of tapestry, antique or piece of silverware, shall not exceed $500.00 unless specifically declared and insured hereunder.

CONDITION B. Valued at amount declared hereunder, but in the event of loss, the liability of this Insurance Company is not to exceed the actual cash value of the property at time and place of such loss.

In the event of the actual cash value of the property insured being in excess of the amount of insurance it is agreed that the Assured shall be regarded as his own insurer for the difference, and shall accordingly bear a rateable share of the loss and/or expense incidental thereto. 

In no event shall the Company be liable for a greater amount than it would cost the Assured to repair or replace property lost or damaged with a material of like kind and quality with proper deduction for depreciation or deterioration howsoever caused.

In the case of antiques (i.e. articles over 100 years old) the Company shall not be liable for anything more than the cost of repairs in event of partial loss nor more than a reasonable market value in event of total loss of the article.

In no event shall the Company be liable for depreciation on repaired articles.

CONDITION C. This insurance is warranted not to inure to the benefit of any carrier, bailee or warehouseman (expect as otherwise specifically provided) or to any Insurance Company that would have been liable for the loss but for the existence of this insurance.

It is further warranted that property insured hereunder shall not be shipped or stored under any contract releasing the carrier or bailee or warehouseman from full legal liability, with the exception of such forms of release as may be customary in respect to household furniture shipments. 

CONDITION D. In all cases of loss the owners of the property shall assign and subrogate all their rights and claims against others to this Insurance Company at time of payment, to an amount not exceeding the sum paid by this Insurance Company, and permit suit to be brought in the Assured's name, but at the Insurance Company's expense, and the Assured further agrees to render all reasonable assistance in the prosecution of said suit or suits. This Insurance Company is not liable for any loss which, without its consent, has been settled or compromised with others, who may be liable therefor.

CONDITION E. This entire policy shall be void if the Assured or his Agent has concealed or misrepresented in writing or otherwise any material fact or circumstance concerning this insurance or the subject thereof; or if the Assured or his Agent shall make any attempt to defraud this Company either before or after the loss.

CONDITION F. In case of loss or damage to any part of a machine, instrument of any kind, set of china or other articles or suite of furniture, consisting when complete for sale or use of several parts, this Company shall only be liable for the proportionate insured value of the part or parts lost or damaged, plus cost of forwarding same to destination.

CONDITION G. Should the shipment be delayed in transit by the order of the Assured or the owner of the property, or should storage charges be incurred while in warehouse for packing and/or consolidation and/or unpacking, this insurance will only extend to cover during such delay, subject to immediate notice being sent to the Company and additional premium paid as required.

CONDITION H. Where this policy covers on docks, wharves, piers and/or bulkheads, goods are insured against the risks of fire, cyclone, hurricanes, earthquakes, floods (meaning the rising of navigable waters) and/or subsidence of docks.

CONDITION I. Wherever the risks of War, Strikes, Riots or Civil Commotions are included under this certificate, the insurance is subject to the following clauses: 

1. This insurance is against the risks of capture, seizure, destruction or damage by men of war, piracy, takings at sea, arrests, restraints and detainments and other warlike operations and acts of kings, princes and peoples in prosecution of hostilities, or in the application of sanctions under international agreements, whether before or after declaration of war and whether by a belligerent or otherwise, including factions engaged in civil war, revolution, rebellion or insurrection, or civil strife arising therefrom, and including the risks of aerial bombardment, floating or stationary mines and stray or derelict torpedoes; but excluding claims for delay, deterioration and/or loss of market, and warranted not to abandon (on any ground other than physical damage to ship or cargo) until after condemnation of the property insured. Also warranted not to abandon in case of blockade, and free from any claims for loss or expenses in consequence of blockade or of any attempt to evade blockade; but in the event of blockade, to be at liberty to proceed to an open port and there end the voyage.

Claims for loss or damage otherwise payable under the terms of these clauses shall not be subject to any conditions of average which may be contained in the Certificate or Special Policy. 

2. Warranted free from any claim based upon loss of, or frustration of, the insured voyage or adventure caused by arrests, restraints or detainment.

3. This insurance does not cover any loss or damage caused by or resulting from any of the following causes:

(a) Commandeering, preemption, requisition or nationalization by the government (de facto or otherwise) of the country to or from which the goods are insured.

(b) Seizure or destruction under quarantine or customs regulations.

(c) Capture,seizure, arrest, restraint, detainment or condemnation by the Government of the United States of America, or of any State therein.

4. This insurance shall not attach the interest hereby insured or to any part thereof

(a) prior to being on board an oversees vessel (for the purpose of this clause 4 an overseas vessel shall be deemed to mean a vessel carrying the interest from one port or place to another where such voyage involves a sea passage by that vessel),

(b) after being discharged overside from an overseas vessel at the final port of discharge,

or 

after expiry of fifteen days counting from midnight of the day on which the overseas vessel is safely anchored or moored at the final port of discharge, whichever shall first occur,

(c) at a port or place of transhipment to another overseas vessel after the expiry of fifteen days (counting from midnight of the day on which the overseas vessel entering with the interest is safely anchored or moored) until the interest is on board the oncarrying overseas vessel.

In the event of the exercise of any liberty granted to the Shipowner or Charterer under the contract of affreightment whereby such contract is terminated at a port or place other than the destination named therein such port or place shall be deemed the final port of discharge for the purpose of this clause 4.

5. The foregoing provisions defining and limiting the period of coverage hereunder shall not be varied or modified by any "held covered" or "continuation" clause or similar clause included in or endorsed on the Policy or Certificate to which these clauses are attached. 

6. This insurance also covers damage, theft, pilferage, breakage or destruction of the property insured directly caused by strikers, locked-out workmen, or persons taking part in labor disturbances or riots or civil commotions; but the foregoing shall not be construed to include or cover any loss, damage or expense caused by or resulting from (a) delay, deterioration or loss of market, or (b) civil war, revolution, rebellion or insurrection, or civil strife arising therefrom.

Exception while the interest insured is on board an overseas vessel, this strikes, riots and civil commotions insurance shall not attach or cover in China, Hong Kong, Dairen, Manchukuo, Spain or Spanish Mediterranean possessions.

CONDITION J. It is warranted that the property insured hereunder is packed and shipped by a member of the National Furniture Warehousemen's Association.

CONDITION K. It is agreed that the Certificate represents and takes the place of the Policy, and conveys all the rights of the Original Policy Holder (for the purpose of collecting any loss or claim) as fully as if the property were covered by a special Policy direct to the holder of this Certificate, and free from any liability for unpaid premiums.

CONDITION L. It is understood and agreed that in the event of claim under this Certificate for loss for which this Company is liable the amount payable to the Assured hereunder will be reduced by the amount of any shipping, handling, warehousing, crating and/or charges due.

SPECIAL CLAUSES

Coverage 1  BASIC COVERAGE——MOTOR VEHICLE AND/OR RAILROAD AND/OR IN CONSOLIDATION WAREHOUSE:

To cover loss or damage caused by fire, lightning, explosion, earthquake, cyclone, tidal wave, overflowing river or stream, theft of entire shipping package, war, strikes, riots or civil commotions (subject to conditions contained elsewhere in this certificate), collision of the conveyance on which the goods are being carried with another vehicle or object (coupling of cars not to be deemed collision), derailment, overturn of vehicle, collapse of bridges; if contained in entirely closed van of wood and/or metal:——tornado, windstorm, rain, hail, snow, cloudburst: (While on ferries)——stranding, sinking, burning or collision of the ferry. While in Warehouse (for purpose of packing and/or consolidation and/or unpacking): Fire, lightning, explosion, tornado, cyclone, windstorm, rain, hail, snow, cloudburst, earthquake, theft of an entire package, tidal wave, overflowing river or stream, collapse of sprinkler tanks, fall of elevators or escalators, war, strikes, riots or civil commotions (subject to conditions contained elsewhere in this certificate).

Coverage 2  NO INSURANCE UNDER THIS SECTION UNLESS NUMBER THEREOF APPEARS ON FACE OF CERTIFICATE AND PREMIUM HAS BEEN PAID THEREFOR.

PILFERAGE——BY MOTOR VEHICLE, RAILROAD AND/OR STEAMER:

To cover the risk of pilferage irrespective of percentage, while in transit (excluding while in Furniture Warehouse), but no claim shall attach hereunder unless the package or packages shall show visible evidence of forcible entry, and such condition is noted by the carrier on the receipt for the goods at the time of delivery.
