M. H. Balanger. being duely sworen. testifyes that J. Boalanger J. Knight, M. Knight, J. Calhoon, & Frazer went to R. Stuart house on the 11" Inst. but no one went in the house but myself. J. Balanger asked him R. Stuart if he had any Government property. R. Stuart told me, Balanger, that he R. Stuart had none. J. Knight. asked R. Stuart to go to Jones house with them to see about some guns. he R. Stuart told J. Knight he could not walk. J. Knight told him R. Stuart that he could ride. we Balanger J. Knight, M. Knight, J. Calhoon & Frazer started from Stuarts house, got about three quarters of a mile from his Stuarts house when Stuart was told to get down. his hands was then tied, then his feet then Calhoon J. Knight & one or two others whiped him with a strap. do not know how many times he was struck. he Stuart made no resistance.
