Evidence of Plaintiff
S.M. Busick, a citizen of Rockingham County
State of North Carolina.

After being duly Sworn Deposeth and says, I was at Squire Green
Shop, when Enaldo was at work. when Joseph H. Simpson drove
up to the door he was in company with R. Wadlington riding in a
buggy after speaking to me he turned around to Enaldo
and said, You have been telling Darn lies on me. Enaldo
Said I dont know that I have, Simpson says, did
you tell J.W. Watson that Thomson Walker and me
went up the road in the morning and returned and stoped
at your house and went inn and rob you of your Silver.

Enaldo said, I did, but I rather told Watson in a joke 
J.H. Simpson said, No Darn Niger or White man shall talk
about me in that way. Simpson step up to Enaldo and
struck him (5) five or (6) Six times with a small riding
switch, no larger than my small finger, Enaldo made
no resistance, Enaldo went out of the shop Simpson
followed him, I followed close after them, then Simpson
said you can go and report me to the Yankees as you wish
Enaldo said I will attend to that tomorrow, when Simpson
replied if you do I will kill you, I did not see Simpson pick
up the brick, I was present at the Second time when the two
parties met I heard no threats made as to taking his life
On this occassion I have known J. H. Simpson nearly all my
life and never knew him to be in a difficulty before,
like this one.
