is an extremely small, compact organization, and the three officers, who in effect control the activities of and manage the defendant, are witnesses in this section and reside in New York County.  

(b) The contracts and alleged cause of action arose in New York County:-

All personal conversation and conferences surrounding the issues involved in this suit took place in New York County.  The contract under which defendant became the selling agent of the plaintiff for the paintings in question was entered into in the County of New York.  There can be no doubt but that the locus contractus lies in New York County.

THE FACTS 

4.  The defendant exhibits, purchases and sells works of art to the public. It enjoys an enviable reputation and has been recognized for approximately fifty years as a highly reputable organization.  

5.  Mr. Germain Seligmann, the President and Treasurer of the defendant, founded the Contemporary American Art Department of the defendant about two years ago in order to assist and promote the relatively unknown younger generation of artists in this country.  The purpose of this department was to introduce and make known new talent to the public.  The department, therefore, does not make outright purchases, but suitable paintings are exhibited on consignment for sale, the usual consignment price being the price set by the artist and defendant's officers less 33-1/3 per cent commission in case of sale.
 
6.  In the early fall of 1946, the plaintiff conferred with Mr. Germain Seligman and deponent. Plaintiff had been recommended to the defendant by the director of a foundation for creative artists known as Yaddo, in Saratoga Springs, N.Y.
