ADVERTISING CODE

1. In advertising, it shall be the aim  of the members to represent their individual interests or services in a manner which will not reflect discredit, either implied or stated, upon the interests or services of another member. In all respects, each member shall conduct its advertising program with a view to maintaining the highest ethical competitive standards for the air transport industry.

2. Members shall adhere to the following specific advertising practices:

A. No member shall advertise a flight time which is less than the flight time shown in its official schedules.

B. No member shall advertise a fare which is lower than the fare shown in its officially filed tariffs, and further, shall not advertise the "lowest" fare for a class of service between any two points unless such tariffs list a fare which is lower than that shown in the official tariffs of any other member for equivalent service between the same points.

C. No member shall advertise the "fastest" service between any two points unless its official schedules reflect a block to block time between such points which is less than the block to block time shown in the schedules of any other member serving the same route segment.

D. Prior to the starting date of a new service, announcement advertising shall include reference to the actual starting date or a phrase such as "coming soon" to make clear that the schedule is not presently operated. The word "now" may be utilized only for announcing availability of reservations in conjunction with advance booking copy.

E. The term "jet" shall be used only when the equipment depicted or described is a "pure jet" aircraft without propellers.

F. The term "turboprop", "jet prop", "prop jet", shall be used to relate only to turbine powered propeller aircraft.

G. "Jet-powered" may be applied to either pure jet, turboprop, or turbocopter equipment so long as other applicable standards are also observed.

H. When turboprop or piston airplanes are illustrated in printed advertising purchased or prepared after December 31, 1960, propellers or traces of propellers shall be shown.

I. If the term "jet-powered" is used without illustration, the term "jet prop", "prop jet", "turboprop" or "turbocopter" shall also be used in the text.

J. If fare is stated in advertising, it shall be the complete fare without tax and so indicated or designate that the amount stated includes tax. Jet fare shall either include any surcharge or designate that surcharge is applicable.

3. Enforcement action shall be limited to the advertising practices described in Paragraph 2 above, and shall not be instituted except upon the receipt by the Enforcement Office of one or more written complaints from a Member(s) bound by this Resolution.
