Joseph W Jenkins of Sumter Co who was arrested and confined in Military prison at Mobile for the Murder of a negro, and who was released on bond to report weekly to the Supt of the Bureau at Demopolis has brought suit against A.J. Derby who was the complainant and principal witness against him.  Jenkins claims damages from Derby for alleged malicious prosecution.

The charge of murder against Jenkins has never been noticed by the Civil Authorities.

Genl. Swayne notified Jenkins that unless he withdrew his suit against Derby he would be rearrested on the charge of Murder.

Jenkins positively declines to withdraw the suit.

I respectfully ask for instructions as to the course to be pursued in this case

I have the honor to state that the arrest of Capt F.O. Steinberg expires on the 6th inst in accordance with Sect. 11 Act of Congress approved July 17, 1863 (Rev Regulations 1963 page 537) it then being forty eight days since he was placed in arrest.  Will you please inform me if practicable when a Court Martial will be convened for his trial.

Corpl. Berry goes down to Greenville with this by tonights train to report to you and remain at Greenville with two (2) men.  You will send Sergt Supplee and four (4) men to their Company here by first train.
