Head Quarters Dist of Alabama
Montgomery Ala March 9" 1867

Dailey Mr S.C.
Dudleyville
Tallapoosa Co. Ala.

Sir

Your communication of the 3rd inst asking as to your rights in the case of certain children bound to you by the Probate Judge on the voluntary petition of their parents, stating that the parents now desire to take them away, is received. In reply I have to say that if the children were apprenticed to you under the laws of Alabama with the consent of their parents, and if you fulfil your duties as prescribed in said law you have a legal right to the custody of the children until they arrive at the age where by the law, the letters of the apprenticeship expire. Your allusions to the children being bastards seem to be superfluous since if born while their parents were slaves, they could not be otherwise the laws of Alabama not authorizing the marriage of slaves or legitimatizing their children.

Very Respectfully
