I have the honor to acknowledge the receipt of your note of 8" inst, asking that in accordance with paragraph IV General Orders No. 28, Head Quarters Department of the Tennessee, Lieut J.F. Conyngham 24" U.S. Infty be returned to his Regiment in your Command.

Your attention is respectfully drawn to so much of the order and paragraph referred to as excludes from its operation "Officers serving under orders direct from these Head Quarters" and a copy of Special Orders No. 100, Par II Head Quarters Dept of the Tennessee under which Lieut. Conyngham is now serving is enclosed herewith for your information.

It is not designed to inconvenience you by the retention of this officer, and if this be the consequence involved, your intimation of the same will have attention.

Your two letters of the 12" inst, one written at Rocky Mount asking that your daughter Lucy be sent to you at once, one written at Hilliardstown asking that she be kept here until Fall when you will make arrangements to come for her, are received.  Free transportation not being furnished at this office the child cannot be forwarded to you, but she will be kept at the Colony here until other disposition of her can be made.

I have the honor to request that if you know of any law passed by the 39" Congress (subsequently to that approved May 11" 1866, which is published on page 46 of the Statutes at large of the 1st Session) extending the time in which appeals may be taken from the State Courts to the United States Courts, you will do me the favor to send me a copy of the same.
