Respectfully returned to Maj Genl Wager Swayne Sub Commr. for Ala. It appears from the report of Lieut. Shorkley that Capt. Graves and Dr Bankholder have engaged in the plantation interest in violation of Circular No 4 B.R.F.&A.L. May 21th 1866. This is brought officially to the notice of the Commissioner. If there are any circumstances which would excuse this violation of orders or reasons exiting why these officers should not be tried by Court Marshal. Maj Gen'l Swayne will please communicate them, and they both will be recommended for muster out. otherwise I will prefer charges against them and apply to the proper Mil Authorities for a Court.
