Respectfully forwarded to Maj. Genl Shorkley asst. You will see by the within report that the civil authorities of this county disregard Genl Pope Order No53 in drawing Jurors. If you desire to have said order enforced you can act accordingly.

Respectfully returned to James F McGogy Sub Asst Commr Talladega Ala. Negros are not to be put upon Juries simply because they are negros but under the acts of Congress applicable to the southern states they are to enjoy equal rights with the white man and nothing more. Section 4063 Revised code of Ala prescribes the qualifications of a white juris without the possession of which no white man can legally serve. As the equality of the negro with the white "before the law" is recognized and maintained by the Military Authorities. the object of G.O. No53 was simply to enforce this equality. and so negros can only serve as jurymen when they can qualify as is required of white men.

Respectfully returned to Sub Asst Commr Gillette The employment of counsel in this case is not deemed advisable because the "later claim" must take precedence of all others and will be secured by the Military Authorities. Major Gillette will therefore call upon the comdg officer of the Pash of Mobile to secure the claims of the negros as against that of Parker Lake and Co and all others except the seventy one dollars and fifty five cents $71.55 cent.
