Mobile 6th Nov 1865

General
At a meeting of the Board of Trustees of the Mobile Medical College, called to take into consideration the condition of the college & to act upon your proposition to base the same, made to Dr. J.C. Nott is by him submitted to the Board, I was instructed to say that the building is not for rent on any terms; that it would be a violation of the trust imposed in us, for us to do so, & that the Board respectfully declines accepting your proposition 
 - I respectfully invite your attention to the following facts in this connection.

The building in question was constructed and the land on which it is erected, was acquired by the board for "the purposes of the Medical College" in pursuance of an act of the Legislature incorporating that institution - This act expressly provides that the property acquired by this board shall "be held solely & exclusively, in trust, for the use & benefit of said college" - The trust could not be more specific, nor impressed in clearer language -
