averse to signing our application to the Governor of this state for Executive Clemency in so far as to recommend a commutation of the   sentence to imprisonment in the penitentiary.

This we are about doing and are awaiting only the signatures of the jury who tried the case to send with it which will, probably, be accomplished to-day or to-morrow.

The papers will be sent to the secretary of state and you can make such communication and request of the Governor as may occur to you proper in addition to what we have sent.
