Also appeared Lafayette Banaus who being by me duly sworn says that he was at the house of said James O. Jefferies on the said 31st day of Decr 1865, the day on the night of which the freedmen on WM Booth's place were robbed, and that he remained at the house of said James O. Jefferies until between ten and eleven o'clock that night: that said Jefferies was at his home at and before night on said day and remained at home until affiant lift there as aforesaid: was there when affiant left, and expected no intentions of leaving home that night and made no preparations for leaving.
