with a Copy of the Act by the Judge who was just from Montgomery. It will thus be seen that those who are supposed to be apprised of the action of the Legislature, were profoundly ignorant of the passage of the Act which Cutler violated, and it would do violence to common sense to suppose, a freedman, who can neither read nor write, would be cognizant of such Legislation. I am informed that the Legislature required copies of the Act to be forwarded to the Probate Judges of the several Counties of the state, but no copy had been furnished the Probate Judge of Marengo County up to the Commencement of said Circuit Court- Indeed, I learn that Cutler was informed as soon as the Judge arrived, which was the first day of said Court, that he was required to procure a license to carry on his trade, and that he immediately applied to the Probate Judge for a license, who informed him that there was no law requiring him to procure one, and refused to issue it- Cutler was fined for carrying on the Barber's trade, between the passage of the Act, and the Commencement of the Court.
