Statement of Sam Lucius (a freedman)

On or about the 31st day of August 1866, he was willfully shot by Pinkney Philips at his (Philips) place - with large Squirrel shot at about four (4) rods -

The affair occurred in this wise.

Sam Lucius went to Philips' Distillery and asked Philips for some Liquor.  Philips said he had none - but told him to come tomorrow.  Sam Lucius started off.  Philips called him back.  When they had other talk, finally Philips proposed to Sam Lucius to steal him some corn and put it in a certain place that night.  Sam Lucius refused and left.  Next day about noon Sam Lucius came for the Liquor  Immediately Philips left the Still and went to his house and brought a gun.  Sam L. asked Philips for the Liquor he promised the day before.
