I have the honor to state, that Judge J.H. Scruggs, now refuses to comply with the terms of the agreement contained in his letter to me of Sept. 21st 1867, in answer to mine of same date, all of which were enclosed to you on Sept. 25th 1867, which related to taking in charge the Freedmens Hospital of this place, on the ground that the former action of himself and the County Commissioners, were based upon the hypothesis, that they were able to comply with the terms proposed. But on a  subsequent investigation found that action to be wrong.
Judge Scruggs says, that if the patients are now turned over to the local authorities they will starve, as they are totally incapable of caring for the poor
A copy of his official communication upon the subject, will be forwarded you as soon as received.
I await your further order in the premises.
