with whom he is now living, as well as for himself. Said Hannah has applied to me as Justice of the Peace for redress. I have no power or authority. Our Probate Judge, if I should try the writ of habeas corpus, I fear would give the child to the father, as under the common law. Indeed he has intimated as much.

I now respectfully ask - that - Inasmuch as said Wade abandoned said Hannah without any provocation, has taken up with divers others, & now living in adultery with one woman, leaving said Hannah alone to support the youngest as best she can, that said Wade be ordered to restore to said Hannah her child Milton & be ordered further not to molest her in future.

I affirm as Justice &c the above to be a true & correct statement of the facts in the case to the best of my knowledge & belief, so help me God.

Very Respectfully,
F.A. Dulany,
Justice of the Peace
Reference: Judge Judge or Judge Byrd of the Supreme Court of Ala.

P.S. Said Wade, with the child, is working now for me
Said Hannah is on Mr. Geo. D. Miller's place.
