Touching that part of the above order which refers to the charge that Richard Harris, col. and others, col- could not obtain in this Court a fair trial concerning their rights and interest, I beg leave to refer you to the subjoined statements first of the attorneys for the said Richard Harris, col. in the cause now pending also the affidavit of Richard Harris, Col, himself. 
Statement of Coman, Jones and Malone 
We the attorneys of Richard Harris, Col. in the matter of the probate of the paper writing purporting to be the last will and testament of William Harris, dec. with full opportunity to know the facts state that the Hon John B. McClellan has fully promptly and pleasantly, in the matter of said will, done and performed everything which the law and a proper discharge of duty required him to do, that we as the attorneys as aforesaid were fully satisfied with the action of said Judge in the premises, and this order of Bvt Brig Genl J.B. Callis was made without our knowledge or consent.
