fled. The time intervening between the Affray in the house, and the shooting was probably from three to five minutes.
The affray was undoubtedly a premeditated and unprovoked assault of Citizens upon Soldiers, and the shooting was with full intent to kill which I think can be all substantiated by competent witnesses
On Sunday morning shortly after the Affray I made the most diligent inquiries, but could procure no trace or clue, as to the whereabouts of the parties, until evening. The police were then informed, but no action was taken by them. On Monday morning I called at the Mashals Office and gave him the names and description of the men I wished to have arrested as being parties to the Affray. No arrests were made on Monday. On Tuesday morning I again called upon the City Authorities and notified them that unless they made teh arrests at once that I should make them, as Military arrests, adn that the parties must be apprehended and punished. In the evening I was notified that two arrests had been made also that Malone had left in a boat for Montgomery on Sunday afternoon.
I was requested by the Marshal to telegraph for Malones arrest this I declined to do had compromised with him by paying for the Telegram. I especially desired that the City authorities should make the arrest feeling confident that, the evidence against Malone, was so strong that they could not avoid convicting him.
