Office Probate Court Macon County Ala
Tuskegee May 13th 1867

Maj Gen. Swayne

Sir,
I desire to submit for your consideration the following case and ask for your opinion and instructions. Ben Huguley a freedman of this county has had, for several years, two wives each of which has a family of children. Last fall he was threatened with prosecution for bigamy but as he then took one wife and abandoned the other there was no prosecution. The abandoned wife then hired herself to Dr. Hodnett of this county where she is getting wages. She also hired her two older children in the same family for their board and clothing and a small amount of money wages.
Ben Huguley was present and was a witness to the contract between Dr. Hodnett and the woman and children. These are the circumstances as I learn them from the parties. Ben Huguley has filed his petition in this office praying for a writ of Habeas Corpus to issue to Dr. Hodnett
