Sir: -
I have the Honor of respectfully submitting the following statement, as to the matter inquired of in your Communication of the 22nd June 1867, based upon a written Communication of Maj Gen. Swayne of the 20th inst.
On or about the 17th of May 1867, one James B. Gibbs and two other freedman Came to my office, and stated that they had been ordered out of one of the Dauphin street cars by the Conductor, and that they, Gibbs and one of the others, desired to institute an action of damages against the Company.
I advised Gibbs, being the only one I know personally not to be too hasty about the matter, but first go and advise with Major Tracy. (yourself) Gibbs thought the advice good & proposed to the other two to go & see you. One of them objects to going, and said he wanted to Commence suit against the Company, but after some Consultation
