Mr Price however took no steps to retain the custody of the Children, and suffered Adeline to carry them with her from his house, to Mr Wm. Allen's with whom she had contracted to live during the year 1866. So far form making any objection to this arrangement, Mr Price expressed to Mr Allen his acquisition therein, and permitted them to remain with their mother at Mr Allen's, until the 2nd week on March last, when he came to Mr Allen's. and forcibly carried them off, in the presence of Adeline who in utter helplessness, heard their unavailing cries to her for protection. 
She at once instituted legal proceedings for the recovery of her children. First by petition to the Probate Judge of Lee County for revocation of the Articles of Apprenticeship, on the ground of their having been obtained without the consent of parents, but it was decided by the Court, that the apprenticeship was legally made, under Sec 1215 Code of Ala. and her petition was therefore refused. She then sued out a writ of habeas corpus before the same Judge, in which she alleged that Price had forfeited his right to their custody and services by not providing them with a sufficiency of good and wholesome provisions, clothing &c as required by Law
