General: I wrote you a somewhat lengthy letter yesterday and in it made mention of a case of robbery assault & battery committed upon the person of one Spencer Swathe a private "M. Co. 1st U.S.C. Art. Hy. while he was at the home of his wife and residence of his former master. This assault was made by two men named Bill McFarlin & Preston Swathe living about 20 miles from this place near Swathe's Bend Powell river near the County line adjoining Campbell Co.
I took the affidavit of the above named Soldier and sending it to Col. Polk requested a guard to be send out to arrest these men. On the afternoon of the 6" Inst Capt. Walter Hill 12" O.V. Cav. reported to me with four men armed with Spencer Carbines. I gave him written orders to arrest these two men and bring along two other white men mentioned in the affidavit as wittensses. [[witnesses]] I had intended to take the testimony of these men and then make charges against the accused sending them to Chattanooga under Guard to be disposed of as the military authority should deem best
