A. Rutherford, Capt. So Dist N.C. There is no evidence that the finding of the jury was in any way influenced by the charge of the court if it was not, this Bureau has no jurisdiction of - on the other hand the Court charged the jury that, "Insolence from a Col'd man was equivalent to a blow from a white man." it was in violation of the Spirit of the "Civil Rights Bill" and the acknowledgment of his excellency the Gov of NC that "there now exists under the laws of this state no discrimination of justice to the prejudice of persons 13 of color" In which case the affidavit of the plaintiff will be taken and a new trial requested, if refused, the defendant should be rearrested and held" until such a time as a proper judicial tribunal may be ready and willing to try him By com'd of Bt. Justin Hodge Asst Supt. whose attention is invited to endorsement of Asst Com'r. N.C. Capt Hodge will return these papers with a report stating if this court charged the jury. that "insolence from a Col'd man was equivalent to a blow from a white man."
